Terms of Service

    1. Acceptance of Terms

    By accessing or using AI Patrol and related services operated by gotCITED ("gotCITED," "AI Patrol," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users, including individuals and businesses.

    2. Service Description

    AI Patrol is a software-as-a-service platform that monitors how artificial intelligence language models respond to queries related to your brand, business, and industry. The Service submits tracking prompts to AI platforms (including ChatGPT, Claude, Gemini, Perplexity, and others) and analyzes whether your brand is mentioned, at what sentiment, and with what frequency. Results are presented in dashboards and periodic reports.

    3. Account Registration & Security

    To use the Service, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized account access at help@gotcited.com. gotCITED is not liable for losses caused by unauthorized account use that results from your failure to secure your credentials.

    4. AI Content Disclaimer

    Important – please read carefully

    AI language models (including but not limited to ChatGPT, Claude, Gemini, and Perplexity) generate probabilistic, non-deterministic responses. The same query can produce different results at different times. gotCITED / AI Patrol makes NO guarantee, representation, or warranty regarding:

    • The accuracy, completeness, or reliability of AI-generated responses
    • Whether your brand is actually mentioned by any AI platform in real-world usage
    • The accuracy of brand mention detection, sentiment classification, or ranking positions
    • That AI visibility results will remain consistent over time
    • That improving your AI visibility score will result in increased business revenue or customer acquisition

    Results are for informational and monitoring purposes only. They should not be used as the sole basis for business decisions, marketing strategies, legal proceedings, or competitive intelligence. gotCITED expressly disclaims liability for any business decisions made based on AI Patrol data.

    5. Subscription & Billing

    Certain features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as otherwise stated in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in service suspension or termination.

    6. Acceptable Use

    You agree not to use the Service to:

    • Violate any applicable law or regulation
    • Track brands, businesses, or individuals without proper authorization
    • Submit prompts designed to harass, defame, or harm individuals or competitors
    • Attempt to reverse-engineer, scrape, or systematically extract Service data
    • Resell or redistribute Service data without written permission
    • Interfere with or disrupt Service infrastructure
    • Submit malicious code, exploits, or security vulnerabilities

    We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

    7. Intellectual Property

    The Service, including all software, designs, content, and analysis methodologies, is owned by gotCITED and protected by intellectual property laws. You retain ownership of your brand data and content. By using the Service, you grant gotCITED a limited, non-exclusive license to process your data solely to provide the Service. gotCITED may use aggregated, anonymized data to improve the Service and for research purposes.

    8. Disclaimer of Warranties

    The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of results. gotCITED does not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

    9. Limitation of Liability

    To the maximum extent permitted by law, gotCITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service. gotCITED's total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to gotCITED in the twelve (12) months preceding the claim.

    10. Indemnification

    You agree to indemnify, defend, and hold harmless gotCITED, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Service, or your brand data.

    11. Privacy

    Your use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference.

    12. Termination

    Either party may terminate the account at any time. You may cancel your subscription through the account Settings page. gotCITED may suspend or terminate your account for violation of these Terms, non-payment, or any other reason with or without notice. Upon termination, your access to the Service will cease and your data will be handled per our Privacy Policy.

    13. Governing Law & Disputes

    These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved through binding arbitration seated in San Diego County, California, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in the state or federal courts located in San Diego County, California. You waive any right to participate in class-action lawsuits.

    14. Changes to Terms

    We may modify these Terms at any time. We will provide notice of significant changes by email or by posting a notice in the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.
